Selling a Home During Separation or Divorce

Reach an agreement first

Try to agree with your spouse on the basics before the home goes on the market: who the listing agent will be, how the asking price will be set, and how the proceeds will be divided. A neutral agent who works for the sale rather than for either person makes the rest of the process easier.

Get legal advice

Speak with a family lawyer early. In British Columbia the family home is usually shared property, and timing matters: the date of separation affects how it is divided under the Family Law Act. Your lawyer can also advise on whether both signatures are needed on the listing agreement and on offers.

Understand the financial picture

After closing, the proceeds are divided according to your separation agreement or court order. Your lawyer handles this step; we make sure the paperwork is in order so nothing holds it up.
